AUTU.lt

Terms of Use

These terms apply to the use of the autu.lt portal (the "Portal"). By registering, logging in or posting a listing you confirm that you have read these terms and undertake to comply with them.

1. General

1.1. The Portal is operated by UAB "Modernex", registered address Chemijos g. 27C-62, LT-51331 Kaunas, Lithuania (the "Operator"). Email: [email protected].

1.2. The Portal is a classified-ads platform where users post listings themselves and contact each other directly. The Operator only provides the technical means to publish information. It is therefore not a party to any sale, lease or other transaction between users, does not conclude or verify such transactions and is not responsible for their conclusion or performance.

1.3. The Operator does not review every listing in advance and does not guarantee that the information, photos, prices or persons in listings are genuine, accurate or lawful.

2. Registration and account

2.1. Only persons with legal capacity to enter contracts (individuals aged 18 or older, or legal entities acting through their representatives) may post listings or use the Portal's services.

2.2. When registering the user must provide truthful, complete and accurate data and promptly update it when it changes. By registering as a business the user confirms they are authorised to act on its behalf.

2.3. The user is responsible for keeping their login details secure and for all actions taken through their account. They must immediately notify the Operator of unauthorised access or loss of credentials. Accounts may not be transferred or sold to others.

2.4. One person must not create multiple accounts to circumvent restrictions or a block.

3. User responsibility for listings

3.1. The user alone is responsible for the content of their listings, including text, photos, prices, contact details and any other information, and for ensuring the listing complies with applicable law.

3.2. The user warrants and undertakes that:

  • they own the item being sold or are entitled to sell and advertise it;
  • the information in the listing is truthful, complete and not misleading, especially regarding the vehicle's condition, mileage, accidents, defects, legal status (pledge, seizure, leasing, wanted status, etc.), origin and documents;
  • they have the right to use the photos and other content they upload, and it does not infringe third-party copyright, trademarks, privacy or other rights;
  • the stated price is genuine and final, and the listing complies with the seller's obligations under the laws of the Republic of Lithuania, including consumer protection, trade and tax requirements;
  • a seller acting as a business complies with consumer protection requirements (information duties, warranties, right of withdrawal, etc.) and is itself responsible for fulfilling them.

3.3. One listing is for one vehicle or item. The same listing must not be repeated in several categories or re-posted. Photos must not contain other websites' marks, phone numbers or advertising.

3.4. The user must deactivate or remove the listing when the item is sold, no longer available or the information has changed.

3.5. By posting content on the Portal the user grants the Operator a free, non-exclusive right to display it on the Portal and in notifications, advertising and social media promoting the listing, and to process it (e.g. resize, apply the Portal's watermark) as needed to provide the service and promote the Portal.

4. Prohibited

It is prohibited to:

  • post false, misleading, fraudulent or unlawful information, including deliberately stating a fake price or condition;
  • sell stolen vehicles or goods, goods without lawful documents, counterfeit goods or items that cannot lawfully be sold;
  • post offensive, defamatory, discriminatory, hateful, violent, pornographic or otherwise unlawful content;
  • impersonate another person or company, or use others' data or photos without permission;
  • use the Portal for fraud, to obtain money or data from users, or to send mass unsolicited messages (spam) or advertising;
  • collect, copy or use the Portal's or other users' data by automated means (scraping, bots) without the Operator's written consent;
  • disrupt or attempt to bypass the Portal's operation or security measures, break into accounts or systems, or spread malware;
  • otherwise violate the laws of the Republic of Lithuania or the European Union.

5. Moderation and the Operator's rights

5.1. The Operator may, at its discretion, without prior notice and without stating a reason, reject, edit, hide or remove a listing, and restrict, suspend or delete a user's account, if the listing or the user's conduct breaches these terms, the law or other users' rights, or upon a reasoned report from a competent authority or third party.

5.2. The Operator is not obliged to monitor information posted on the Portal, but on receiving a report or learning of a breach it may take necessary measures, including removing content and passing information to law-enforcement authorities.

5.3. Where a listing is removed or an account blocked for a breach, the Operator is not obliged to refund related payments if the breach is the user's fault.

5.4. The Operator may change the Portal's features, temporarily or permanently discontinue all or part of the services, and carry out maintenance.

6. Payments

6.1. Some services on the Portal are paid. The applicable price and service terms are shown on the Portal before payment. The Operator may change prices and terms by publishing them on the Portal; changes do not affect services already paid for.

6.2. Payments are accepted through the payment services shown on the Portal. The Operator does not store bank card or online banking credentials.

6.3. Paid services end when their term expires unless a new period is paid for.

6.4. Invoices for businesses are issued under Lithuanian law. The user is responsible for providing correct details.

7. Limitation of the Operator's liability

7.1. The Portal and its services are provided "as is". The Operator makes reasonable efforts to keep the Portal running but does not guarantee it will be free from errors, interruptions or technical failures.

7.2. The Operator is not liable for:

  • the content of users' listings, or their accuracy, completeness or lawfulness;
  • transactions between users, their conclusion or performance, the quality, origin or legal status of goods, payments or the parties' conduct;
  • users' losses caused by other users' actions, fraud, or false or misleading information;
  • losses caused by technical failures, interruptions, cyber attacks, disruptions of third-party services (e.g. payment, communications or hosting services) or force majeure;
  • lost data, lost income or other indirect damage.

7.3. To the extent permitted by mandatory law, the Operator's liability to a user for any damage is limited to direct losses not exceeding the amount the user paid to the Operator for the Portal's services in the previous 12 months. This does not apply where the law does not allow liability to be limited (for example damage caused intentionally or by gross negligence) and does not restrict rights that cannot be waived under the law of the Republic of Lithuania.

8. User's obligation to compensate

8.1. The user undertakes to compensate the Operator for all losses, costs and fines (including reasonable legal costs) arising because the user breached these terms or the law, because information or content in the user's listing infringed third-party rights or was unlawful, or because of the user's other actions.

8.2. If a third party or authority makes a claim against the Operator concerning a user's listing or actions, the user must cooperate, provide the necessary information, deal with the claim themselves and compensate the Operator.

8.3. The Operator may provide a user's data to law-enforcement and other competent authorities and to injured persons to the extent required by law or necessary to protect legitimate interests.

9. Reporting violations

If you notice unlawful content or content that breaches these terms, use the "Report listing" button or email [email protected], identifying the listing and the reason. We review reports within a reasonable time and remove listings where necessary.

10. Safe-buying recommendations

Buyers are urged to check the seller, the vehicle's condition, documents and legal status themselves, and not to pay advance sums without verifying the seller. See "How to buy safely" for more tips. The Operator does not guarantee the accuracy of information stated in listings.

11. Personal data

Personal data is processed in accordance with the Privacy Policy and Regulation (EU) 2016/679 (GDPR).

12. Changes and final provisions

12.1. The Operator may amend these terms by publishing a new version on the Portal. By continuing to use the Portal the user accepts the new version.

12.2. If any provision of these terms is held invalid, the remaining provisions stay in force.

12.3. These terms are governed by the laws of the Republic of Lithuania. Disputes are resolved through negotiation and, failing that, in the courts of the Republic of Lithuania at the Operator's registered office, unless mandatory law provides otherwise. Consumers may also contact the State Consumer Rights Protection Authority or use the EU online dispute resolution platform (ec.europa.eu/consumers/odr).
